Coloquei preliminar de nulidade do art 564, IV do CPP por vício de formalidade da instrução do art 400 CPP, violando o devido processo legal, ampla defesa, contraditorio ocorrendo o cerceamento de defesa. Porem, o gabarito preliminar não constatou está preliminar. Será que eles estão certos? Acredito que não! Houve nulidade absoluta, norma de ordem pública. Será que eles sabem mais que nos!?!… Alguém mais colocou essa preliminar?
